From "Legislative Update"

Senator Tom Harkin (D-IA) has presented a bill to Congress that would prohibit any "adverse action" by employers because a person uses a "mitigating device."

"Millions of people we intended to be protected under the ‘Americans with Disabilities Act,’ including people with epilepsy, diabetes and cancer are not protected any more," Sen. Harkin said. The bill declares that an adverse action because of mitigating circumstances constitutes discrimination. Those in favor of the bill feel it is necessary in order for the disabled to take part in minstream American life. Those against it feel it opens the door to frivolous lawsuits. (H.R.3195)
